  1. Scope

These General Terms and Conditions (GTC) apply to all orders placed through our online shop, Surfish. The contracting party is: Surfish, Arend Braye Str. 50, email: surfish@surfish.eu

By placing an order, you agree to the following terms.

  1. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to order. By clicking the "Buy Now" button, you submit a binding order. The contract is concluded when we accept your order by sending a confirmation email.

  1. Prices and Shipping Costs

All prices are listed in euros (€) and include statutory value added tax. Shipping costs are charged in addition to the purchase price and are clearly shown during the ordering process.

  • Germany: 4.90 € shipping (free on orders over 50 €)
  • EU: 10.90 € shipping (free on orders over 100 €)
  • Switzerland: 10.90 € shipping (free on orders over 100 €)
  1. Delivery

Delivery is carried out by DHL or a comparable shipping provider.

  • Delivery time Germany: 2 to 4 business days
  • Delivery time EU: 4 to 7 business days
  • Delivery time Switzerland: 7 to 14 business days, including customs handling

If a product is unavailable, we will inform you promptly by email.

  1. Payment

Payments can be made using the following methods:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Klarna (invoice and installments)
  • Instant bank transfer
  • Apple Pay / Google Pay

Your payment method will be charged immediately upon completion of your order.

  1. Right of Withdrawal

The statutory right of withdrawal of 14 days applies. Details can be found in our Right of Withdrawal notice.

  1. Returns

As the buyer, you bear the direct costs of returning the goods. Returns are only accepted for unused goods in their original packaging. For hygiene reasons, used ponchos are excluded from the right of withdrawal.

  1. Retention of Title

The goods remain our property until full payment has been received.

  1. Warranty

Statutory warranty rights apply. In the event of defects, you are entitled to repair or replacement.

  1. Liability

We are only liable for intent and gross negligence. In cases of slight negligence, we are only liable for damages resulting from injury to life, body, or health, as well as claims under product liability law.

  1. Data Protection

Your data is used exclusively to process your order and is not shared with third parties unless necessary to fulfill the contract. Further information can be found in our Privacy Policy.

  1. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on the Contract for the International International Sale of Goods (CISG). Mandatory consumer protection provisions in your country of residence remain unaffecteded.
